Continuing power of attorney

Any one of us may, due to an accident or illness, find ourselves in a situation where we are no longer capable of managing our own affairs. If the incapacity is not merely temporary, a guardian is required. An authority may appoint a guardian who will have the duties, powers and obligations prescribed by law.

With a Continuing Power of Attorney, an individual can determine in advance who should act as their guardian, what tasks and powers the guardian will have, whether a separate permission is required for certain actions, and what kinds of reports the guardian must provide. In this way, each person can define the extent to which their appointed attorney is bound by statutory rules and the extent to which they may act with greater discretion.

Regardless of age, it is wise for everyone to prepare their own Continuing Power of Attorney for the future.
