The transfer of a business or farm to a successor should be planned well in advance. Succession is often carried out in stages. Various arrangements may also be required if part of the assets — for example, premises or investment property — is intended to remain with the transferor.

In addition to drafting a deed of sale or deed of gift, succession may involve preparing documents such as a shareholders’ agreement, lease agreements or a will. It is usually advisable to request an advance ruling from the tax authorities.
