Disputes arising from housing and real estate transactions are unfortunately common. Typically, the buyer feels that the seller has deceived them, while the seller may think the buyer simply regrets the purchase or is trying to obtain money. Sometimes this may be true, but in most cases the issue concerns a defect that neither party was aware of at the time of the sale. Under the law, the seller may not benefit from a latent defect, while the buyer is not entitled to compensation for an issue that they knew about—or reasonably should have discovered—before the transaction. For this reason, a thorough condition inspection before the purchase is always advisable. Many issues can also be avoided with a well‑drafted sale agreement.

Regardless of which party to the sale we represent, it is essential that experts are involved as soon as a problem arises. The buyer must lodge a complaint in time and in the manner prescribed by law. The seller must be allowed to participate in the necessary investigations and must respond appropriately to the claims presented.

Disputes relating to home purchases often involve a person’s entire wealth and strong emotions, making the process very stressful and burdensome. Court outcomes are rarely entirely predictable. For these reasons, seeking a settlement—either through negotiations or court‑assisted mediation—is often a good alternative. If settlement is not possible, we naturally pursue the matter fully through to the end.
